Terms for Provision of Services


Definitions

“Company,” “We,” “Us,” or “Our” refers to Capital Brickwork.
“Client” or “You” refers to the person or entity instructing the Company to carry out the Works.
“Quotation” refers to the written estimate of costs for the Works, valid for 30 days unless otherwise stated.
“Works” refers to the brickwork, building, or related services to be provided by the Company as set out in the accepted Quotation.

Quotations and Orders

All Quotations are an invitation to treat and do not constitute a binding offer. A contract is only formed when you accept our Quotation in writing (including email) and we formally confirm acceptance of your order.

Any special requirements or needs for the Works must be fully detailed to us prior to the acceptance of the Quotation. We will not be responsible for issues arising from incomplete or inaccurate information provided by you.

Fees and Payment

The total fee for the Works, including any labour and material charges, will be laid out in the Quotation. Fees are inclusive of VAT at the standard rate, unless stated otherwise.

We reserve the right to request a **non-refundable deposit** upon acceptance of the Quotation.

Payment terms will be specified in the Quotation and/or Invoice, typically requiring payment in full within **[Insert Number, e.g., 7 or 14]** days of the date of the invoice/completion of the Works.

We reserve the right to charge interest on any overdue sums at the rate permitted by the Late Payment of Commercial Debts (Interest) Act 1998.

Materials and Title

**Title in the goods (materials)** shall not pass to you until we have received full payment for the Works. Until such time, we reserve the right to reclaim or remove any goods supplied.

We will use reasonable efforts to match new brickwork to existing structures but cannot guarantee an exact match due to variations in colour, texture, and weathering.

Completion and Delays

Any dates quoted for the commencement or completion of the Works are estimates only. We will not be liable for any delay in the completion of the Works howsoever caused. Time shall not be of the essence unless expressly agreed in writing.

We will not be liable for delays caused by factors outside of our reasonable control, including but not limited to adverse weather, material shortages, or actions by a local authority or other third parties.

Client Obligations

The Client must ensure that we have clear and safe access to the site at all times required to complete the Works.

The Client is responsible for obtaining all necessary **planning permissions** and **building control approvals** unless we have specifically agreed in writing to handle these as part of the Works.

Liability and Warranty

We warrant that the Works will be carried out with reasonable care and skill and that materials used will be of satisfactory quality.

We shall not be liable for any loss, damage, or defect in the Works arising from:

  • Normal wear and tear.
  • Misuse, neglect, or lack of proper maintenance by the Client.
  • Alterations or repairs carried out by third parties (including the Client).
  • Damage caused by other contractors or trades on site.

Our total liability to you shall not exceed the total price paid for the Works. We will not be liable for any indirect or consequential loss, including loss of profit or business interruption.

Cancellation

If you are a consumer, you may have the right to cancel the contract during a **14-day “cooling-off” period** under The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, provided the Works have not yet commenced.

If the Client cancels the contract after the cooling-off period, the Client will be liable for all direct and indirect expenses and costs incurred by the Company up to the date of cancellation, including loss of earnings and the cost of any non-returnable materials.

General Provisions


Data Protection

We will only use your personal information as set out in our Privacy Policy.

Governing Law

These Terms and Conditions and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of **England and Wales**.
